The Auditor General is established under the Navajo Nation Council, appointed by the Speaker, and serves at the Council’s pleasure — meaning the Council can remove the Auditor General at any time, for any reason.

The case that shaped this

Shirley v. Morgan (Navajo Supreme Court, 2010). When the Council dissolved the office meant to finish reforming the government, the Court ordered it restored. It is a real example of what happens when the branches collide — the Judicial branch acts as the referee.
